Participant Waiver,
Release & Consent

This document must be read in full and completed by a parent or legal guardian for all participants under the age of 18, or by the participant if 18 years of age or older, prior to participation in any SI Elite Development program, training session, camp, clinic, or event.

⚠ Read Before Signing

This is a legally binding document. By completing and submitting this waiver, you are giving up certain legal rights, including the right to sue SI Elite Development, its owners, coaches, staff, volunteers, and affiliated parties for injuries, accidents, or losses that may occur during participation. Please read every section carefully before signing.

Identification of Parties

"SI Elite Development" refers to SI Elite Development, its founder Keith Kiner, coaches, trainers, staff members, volunteers, guest instructors, affiliated athletes, mentors, and any agents acting on behalf of SI Elite Development, operating in the State of Illinois.

"Participant" refers to the athlete named in the signature section of this document who will be taking part in SI Elite Development programs, training sessions, camps, clinics, events, or any related activities.

"Parent/Guardian" refers to the signing adult who is the legal parent or court-appointed guardian of a Participant under the age of 18, or the Participant themselves if 18 years of age or older.

"Program Activities" includes but is not limited to: individual training sessions, group training sessions, drop-in sessions, monthly training programs, speed and agility training, sport-specific skill development, youth mentorship program activities, camps, clinics, scrimmages, demonstrations, community events, travel to and from events, and any other activity organized or facilitated by SI Elite Development.

Description of Program Activities

SI Elite Development provides youth athletic training, skill development, speed and agility conditioning, sport-specific coaching, mentorship, and leadership development programs for athletes ages 5 through 18 in Southern Illinois. Programs currently offered or in development include:

  • Basketball skill development and conditioning
  • Football skill development, speed, agility, and position training
  • Baseball mechanics, hitting, pitching, and fielding
  • Softball pitching, batting, and fielding
  • Swimming technique and competitive development
  • Multi-sport speed, agility, and explosive conditioning
  • Volleyball serving, passing, setting, and team positioning
  • Youth Mentorship Program (ages 16–18)
  • Camps, clinics, and community sporting events

All activities involve physical exertion, athletic movements, contact with equipment, and potentially incidental contact with other participants. Participant understands the physical nature of these activities prior to participation.

Assumption of Risk

I acknowledge and understand that participation in athletic training and sports activities involves inherent risks that cannot be completely eliminated regardless of the care taken to avoid injuries. These risks include, but are not limited to:

  • Sprains, strains, muscle pulls, and soft tissue injuries
  • Fractures, dislocations, and bone injuries
  • Concussions, head injuries, and traumatic brain injury
  • Eye injuries and dental injuries
  • Heat exhaustion, heat stroke, and dehydration
  • Cardiovascular events during physical exertion
  • Contact injuries from other participants, equipment, or surfaces
  • Injuries from falls, collisions, or unexpected movements
  • Pre-existing condition aggravation or worsening
  • Permanent disability or, in extreme cases, death
  • Exposure to communicable diseases or illness
I, on behalf of myself and/or the Participant, voluntarily assume all risks associated with participation in SI Elite Development program activities, whether those risks are known or unknown, foreseen or unforeseen, arising from the negligence of SI Elite Development or otherwise.

I confirm that the Participant is physically capable of participating in athletic activities and has no known medical condition that would prevent safe participation, or that I have disclosed all relevant medical conditions in the health information section of this form.

Release & Waiver of Liability

In consideration of the Participant being allowed to participate in SI Elite Development program activities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged:

I, for myself and on behalf of the Participant, and our respective heirs, executors, administrators, legal representatives, successors, and assigns, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SI Elite Development, Keith Kiner (Founder), Tony Williams Jr., all coaches, trainers, staff, volunteers, mentors, guest instructors, facility owners, and their respective agents, officers, employees, and representatives (collectively "Released Parties") from any and all claims, demands, losses, damages, costs, expenses, and causes of action of any nature, whether known or unknown, arising out of or related to Participant's participation in any SI Elite Development activity.

This release includes, but is not limited to, claims arising from:

  • Ordinary negligence of the Released Parties
  • Failure to adequately supervise or instruct
  • Defective or improperly maintained equipment
  • Inadequate safety measures or warnings
  • Actions or omissions of other participants
  • Conditions of training facilities or surfaces
  • Medical or emergency response decisions made on Participant's behalf
  • Transportation to or from SI Elite Development events

Illinois Notice: This release is governed by the laws of the State of Illinois. The parties agree that any legal action arising from this agreement shall be brought exclusively in the courts of Randolph County or Jackson County, Illinois. If any provision of this release is found unenforceable, the remaining provisions shall remain in full force and effect.

Indemnification & Hold Harmless

I agree to indemnify, defend, and hold harmless SI Elite Development and all Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to:

  • Participant's participation in any SI Elite Development activity
  • Any breach of this agreement by me or the Participant
  • Any misrepresentation made in this waiver
  • Any injury to a third party caused by the Participant during program activities
  • Failure to disclose known medical conditions or physical limitations

Medical Authorization & Emergency Treatment

I hereby authorize SI Elite Development staff to:

  • Administer basic first aid as needed during program activities
  • Contact emergency medical services (911) in the event of a medical emergency
  • Authorize emergency medical treatment for the Participant if I cannot be reached
  • Transport or arrange transport of the Participant to the nearest appropriate medical facility in an emergency

I acknowledge that SI Elite Development staff are not licensed medical professionals and that any first aid administered is done in good faith as a reasonable response to an emergency situation. I agree that SI Elite Development shall not be liable for medical treatment decisions made in emergency situations when a parent or guardian cannot be reached.

I accept full financial responsibility for any medical treatment received by the Participant, including emergency services, hospital care, or follow-up treatment. SI Elite Development does not provide medical insurance coverage for participants.

It is the responsibility of the parent/guardian to ensure the Participant has adequate health insurance coverage prior to participation.

Code of Conduct & Behavioral Standards

SI Elite Development is committed to providing a safe, respectful, and positive environment for all athletes. All participants and their families are expected to adhere to the following standards:

  • Respect: Treat all coaches, staff, fellow athletes, and facility personnel with respect at all times
  • Language: No profanity, derogatory language, racial slurs, or disrespectful speech of any kind
  • Violence: Zero tolerance for fighting, bullying, threatening behavior, or intentional harm to others
  • Equipment: Handle all training equipment properly and report any damage immediately
  • Substances: No alcohol, tobacco, vaping, or illegal substances on or near any training facility
  • Punctuality: Arrive on time and notify coaches in advance if unable to attend a scheduled session
  • Attire: Wear appropriate athletic clothing and footwear for all training activities
  • Electronic Devices: Phones and devices should be put away during active training sessions unless directed by a coach
  • Parent/Guardian Conduct: Parents and guardians are expected to model the same respectful behavior during all events and interactions

SI Elite Development reserves the right to remove any participant from the program, without refund, for violations of this code of conduct, behavior that endangers the safety of others, or conduct that is contrary to the values and mission of SI Elite Development. This decision rests solely with the program leadership.

Photo, Video & Media Release

SI Elite Development regularly documents training sessions, camps, clinics, and events through photography, video recording, and other media for purposes including but not limited to:

  • Social media content (Facebook, Instagram, TikTok, YouTube, and other platforms)
  • Website content at sielitedevelopment.com
  • Marketing and promotional materials
  • Athlete development and coaching review
  • Sponsorship and partnership communications
  • News coverage and press releases
  • Training documentation and program records
Default Policy: By signing this waiver and enrolling in SI Elite Development programs, you are granting permission for the Participant to be photographed and/or video recorded during program activities. SI Elite Development may use this content for the purposes listed above without additional compensation or further consent required.

If you do NOT wish for the Participant to be photographed or filmed, you must indicate this below. SI Elite Development will make reasonable efforts to honor opt-out requests, however we cannot guarantee the Participant will never appear incidentally in group content. Opting out does not affect the Participant's ability to enroll in or participate in any program.

All media content remains the property of SI Elite Development. SI Elite Development will not sell or license images of minors to third parties for commercial purposes without separate written consent.

Youth Mentorship Program — Additional Terms

This section applies only to participants (ages 16–18) enrolled in the SI Elite Development Youth Mentorship Program. If the Participant is not enrolled in this program, this section does not apply.

The Youth Mentorship Program places high school athletes (ages 16–18) in a paid, supervised assistant training role working with younger SI Elite Development athletes. Participation in this program involves additional responsibilities and acknowledgments:

  • Mentors work under direct supervision of SI Elite Development head coaches at all times
  • Mentors are not independent contractors — all mentoring activities must be conducted within scheduled SI Elite Development sessions
  • Mentors may not make independent decisions regarding training methods, drills, or athlete safety without coach approval
  • Mentors are subject to all Code of Conduct standards as both a participant and a representative of SI Elite Development
  • Compensation is provided per session worked as agreed upon at time of acceptance into the program
  • SI Elite Development reserves the right to remove a mentor from the program at any time for conduct, performance, or attendance issues
  • Participation as a mentor does not create an employment relationship — mentors are volunteer participants receiving stipend compensation
  • Parent/guardian of the mentor acknowledges and consents to their minor child serving in this role

Illinois Child Labor Notice: Participants in the Youth Mentorship Program who are under 16 years of age are not eligible for compensation under this program in compliance with Illinois child labor laws. Minimum age for compensated mentorship participation is 16 years.

Privacy & Personal Information

SI Elite Development collects personal information including names, contact information, age, grade, athletic background, and health information for the purpose of administering programs and ensuring participant safety. This information:

  • Will not be sold to third parties
  • Will not be shared with sponsors or partners without separate written consent
  • May be shared with medical personnel in an emergency
  • Is stored securely and used solely for program administration purposes
  • May be used in aggregate, anonymous form for program reporting

Illinois residents have rights under applicable state privacy laws. To request access to, correction of, or deletion of your personal information, contact us at sielitedevelopment@dreamittoreality.com.

General Provisions

  • Entire Agreement: This waiver constitutes the entire agreement between the parties regarding liability and risk, and supersedes all prior communications on these matters
  • Severability: If any provision of this agreement is found invalid or unenforceable, the remaining provisions continue in full force
  • Governing Law: This agreement is governed by and construed in accordance with the laws of the State of Illinois
  • Venue: Any disputes arising from this agreement shall be resolved in Randolph County or Jackson County, Illinois
  • Duration: This waiver remains in effect for the entire duration of the Participant's enrollment in SI Elite Development programs and is renewed upon each program season or re-enrollment
  • Voluntary Participation: I acknowledge that participation in SI Elite Development programs is voluntary and that I have chosen to allow the Participant to participate with full knowledge of the risks involved
  • Legal Capacity: I represent that I am of legal age (18 or older) and have the legal authority to sign this agreement on behalf of the Participant
  • No Guarantees: SI Elite Development makes no guarantees regarding athletic improvement, college recruitment, scholarship opportunities, or any specific athletic outcome
